The European Court of Human Rights (ECtHR) delivered this Tuesday its judgment on the case of N.D. and N.T. vs Spain, concerning two sub-Saharan migrants who, having crossed the fence of the border of Melilla (Spanish territory in the African continent), were immediately returned to Morocco as migrants. The ECtHR has condemned Spain on the grounds that the applicants were in Spanish territory and therefore this action represents a collective expulsion, which violates the prohibition of summary expulsions and the right to an effective remedy.
