A Polish man, M.K., went to prison after the court mistakenly ruled that he committed a crime during the period of his conditional suspended sentence. Coincidentally, the true perpetrator had exactly the same name. The State Treasury Solicitors’ Office did not see any justification for paying damages to the man for spending four months in prison. According to the office, M.K. was unemployed and homeless, and therefore detaining him did not worsen his situation. A court has now reversed this and awarded 80,000 PLN (roughly 18,000 EUR) in damages to M.K.
