New law on in vitro fertilization came into force in Poland last month. This is the first regulation introducing standards in this area. However, according to the ombudsman and the Helsinki Foundation for Human Rights, it violates the constitutional prohibition of discrimination in access to health care, as the law does not allow a women to undergo the treatment unless she is married or in a stable relationship with a man. The aim of this provision is to ensure that a newborn child would have both parents.
