The proposed bill, which enables health insurers to access medical files without the consent of patients, is in violation with the right to privacy (Article 8 of the ECHR), says a letter by lawyers commissioned by the VvAA, the biggest Dutch umbrella healthcare organization. The VvAA has sent the letter to members of the Senate, who will discuss the bill on November 8. The proposed law would make it possible for healthcare providers to share patients' medical files – without their consent –to insurers. It is intended to fight fraud in the health care industry.
