La Corte Costituzionale Tedesca ha messo in programma una tre giorni di processo nel meso di marzo 2016, per affrontare il caso della messa al bando del partito di estrema destra NPD e delle organizzazioni correlate. Gli ostacoli all'avvio di tale procedimento sono tanti poiché i partiti politici sono protetti dalla Costituzione Tedesca. In base all'articolo 21.2 della Costituzione, i partiti sono incostituzionali se "dichiarano di limitare o abolire i fondamenti della libertà democratica o di mettere in pericolo l'esistenza della Repubblica Federale Tedesca."
