Il giudice che ha avviato le indagini sulle brutalità della polizia lungo la frontiera di Melilla ha deciso di perseguire il comandante capo della Guardia Civile di Melilla per abuso d'ufficio. Il comandante ha ordinato ai suoi ufficiali di respingere i migranti al momento del loro ingresso in Spagna attraverso Melilla, senza rispettare il procedimento previsto dalla Legge sull'Immigrazione. Secondo il giudice, tale ordine è illegale e può costituire reato. Il giudice ha anche chiarito che, contrariamente a quanto ha sostenuto il governo, il confine di Melilla è parte del territorio spagnolo.
