Dal 2010 nessun magistrato rumeno ha mai pagato per gli errori commessi che hanno provocato sentenze di condanna allo stato da parte della Corte Europea dei Diritti Umani (Corte EDU). Questo perché la prescrizione per errori giudiziari in Romania è più breve (2, 5 o 8 anni) rispetto ai tempi di emissione di sentenze da parte della Corte EDU - in media, 7 o 8 anni (compresi i casi di contenzioso strategico).
La Romania è al quarto posto per numero di condanne CEDU, dopo Turchia, Italia e Russia. Nel 2015 ha pagato 8 milioni di euro di soldi pubblici in risarcimenti per condanne da Strasburgo.
