El Tribunal Supremo confirmó el 29 de marzo las condenas a los tres acusados de difamación racial e incitación a la discriminación por el Tribunal de Apelaciones de Arnhem-Leeuwarden. Durante una manifestación de 2011 en Enschede, de la Nederlandse Volks Unie (Unión del Pueblo de los Países Bajos), los sospechosos gritaron, "¡Ali B. y Mustafá, volved ya a Ankara!" Previamente el tribunal había decidido que estas declaraciones generan un ambiente de desprecio racista en un sentido amplio. Por ello, suponen difamación e inictación al odio.
