Unos documentos que reveló recientemente Statewatch muestran que los Estados miembros de la UE están investigando todas las opciones para mantener, si no ampliar, su actuales programas de retención de datos, a pesar de que una sentencia del Tribunal de Justicia de la UE dictaminó que la retención de datos global es ilegal. Los Estados miembros se están centrando en un nuevo concepto: 'retención limitada de datos', que es en realidad retención de datos global pero con un nuevo nombre, junto con enmiendas al borrador del Reglamento sobre privacidad digital para facilitar la retención de datos.
