En una declaración del lunes 20 de febrero, el gobierno polaco se negó a poner en marcha reformas judiciales consideradas por la Comisión europea fundamentales para mantener el Estado de derecho. El país corre el peligro de que se le retire su derecho a voto en la UE, pero una decisión así exigiría un consenso unánime de los demás Estados miembro y esto no sucederá: el gobierno húngaro ha dicho que no apoyará ninguna sanción contra Varsovia. La Comisión le ha dado al gobierno polaco hasta final de febrero para poner en marcha medidas para proteger los poderes del Tribunal Constitucional.
