La Corte di Giustizia dell'Unione Europea (CGUE) ha espresso un'interessante parere in tema di presentazione di istanze di pronuncia pregiudiziale, in cui applica un'interpretazione più restrittiva della teoria dell'"acte clair". Nel caso João Filipe Ferreira da Silva e Brito et al. c. Portogallo, la CGUE ha concluso che la dottrina dell'"acte clair" (Cilfit) non fosse applicabile e che la Corte Suprema Portoghese avrebbe dovuto presentare un'istanza di pronuncia pregiudiziale alla Corte di Giustizia per escludere la possibilità di un'errata interpretazione del diritto comunitario.
