La scorsa settimana è arrivato alla Corte di Giustizia Europea un caso che dovrebbe gettar luce sulla legittimità dello streaming. Per l'ente olandese anti-pirateria BREIN e le autorità spagnole mettere a disposizione o guardare video piratati viola la Direttiva UE sui diritti d'autore, ma per la Commissione Europea chi guarda questi video non viola alcuna legge. La questione principale a cui la corte dovrà cercare di rispondere è se sia possibile vendere media-player pre-programmati con link a fonti piratate, per esempio attraverso "add-on"? La sentenza finale è prevista a inizio 2017.
