El Tribunal Europeo de Justicia se ha pronunciado sobre la nueva normativa sobre los desahucios por hipotecas, que ya había sido modificada debido a otra decisión del TJUE que dictaminó que infringía en la Directiva sobre las cláusulas abusivas. El Tribunal ha establecido que la nueva ley, que permite a bancos apelar la decisión de denegar los desahucios, pero impide que los particulares apelen cuando el juez decide no denegarlo, viola tanto la Directiva mencionada como el derecho a un juicio justo. Desde el inicio de la crisis, unas 300.000 familias han perdido sus hogares en España.
