A pesar del buen marco normativo del que goza, el sistema penal italiano sigue fallando a los extranjeros, especialmente a quienes no hablan italiano, según una investigación de Antigone (organización miembro de Liberties) que estudió las primeras fases de los procedimientos penales, desde el arresto al tribunal unos días después. Entre los problemas destacados figura la mala organización de los servicios de traducción, el tiempo limitado disponible para hablar con su abogado y el uso limitado de alternativas a la detención.
