Un tribunal de Berlín ha dictaminado que la configuración de privacidad predeterminada de Facebook y el uso de datos personales violan las leyes sobre consumo alemanas, pues la empresa no proporciona a sus usuarios la información suficiente para que puedan dar un consentimiento significativo. La denuncia, presentada por la Federación de Organizaciones Alemanas de Consumidores, acusaba a Facebook de forzar ilegalmente a los usuarios a elegir ciertas opciones. El tribunal ha declarado que 5 configuraciones predeterminadas y 8 cláusulas adicionales de las condiciones de servicio infringen la ley.
