El Tribunal de Justicia de la Unión Europea (TJUE) ha dictaminado que un usuario de Facebook en Austria puede iniciar un procedimiento individual contra Facebook-Irlanda (donde se encuentra su sede internacional) ante un tribunal austriaco. Sin embargo, este derecho no está garantizado si quiere iniciar un procedimiento colectivo como representante de otros consumidores. El TJUE respondió una solicitud de resolución preliminar de un juez austriaco. Facebook alegaba que los tribunales austriacos no tienen jurisdicción. La sentencia del caso C-498/16 se entregó el 25 de enero de 2018.
